はじめに

本利用規約 (以下「本規約」) は、梅谷 正史 (以下「当方」) が提供するモバイルアプリ Margent (以下「本アプリ」) の利用条件を定めます。

本アプリをダウンロード・インストール・利用することにより、ユーザーは本規約に同意したものとみなします。本規約に同意できない場合は、本アプリを利用しないでください。

第 1 条 (定義)

  • 「本アプリ」: Margent (iOS / Android 版)
  • 「本サービス」: 本アプリおよびバックエンドサーバーによる文字起こし・翻訳・音声合成等の処理機能の総称
  • 「ユーザー」: 本アプリを利用するすべての個人
  • 「ユーザー指定コンテンツ」: ユーザーが iTunes Search 等を経由して自発的に検索・購読した第三者ポッドキャスト
  • 「Margent 提供コンテンツ」: 当方が制作・許諾取得・パブリックドメイン素材として本アプリに同梱する音声・テキスト

第 2 条 (本サービスの内容)

  1. 本アプリは、ユーザーが指定した公開ポッドキャストフィードに対して、以下の処理を提供します:
    • 音声ファイルの取得とユーザー端末への保存
    • 音声から英語テキストへの文字起こし
    • 英語テキストからユーザー指定言語への AI 翻訳
    • 翻訳テキストの音声合成
    • 元音声と合成音声を交互に再生する Comprehensible Input 形式での学習向け再生
  2. 本サービスは英語学習補助を主目的とした アクセシビリティ補助機能 として提供されます。
  3. 本サービスはアカウント登録を要しません。

第 3 条 (コンテンツの取扱いと著作権)

3.1 ユーザー指定コンテンツについて

  1. 第三者ポッドキャストへのアクセスは、ユーザー自身が検索・選択・購読を行うことにより成立します。
  2. ユーザーは、自らが指定するポッドキャストフィードの利用が、関係する著作権法・配信者の利用規約・各国法令に違反しないことを確認する責任を負います。
  3. 本アプリは取得したコンテンツを ユーザーの端末内および当方のサーバー内で当該ユーザーのためにのみ処理 し、他のユーザーへ再配信しません。
  4. AI 翻訳・音声合成によって生成された派生テキスト・派生音声は、ユーザーの個人的な学習目的にのみ利用が認められ、第三者への再配布・公衆送信・商用利用は禁止します。

3.2 Margent 提供コンテンツについて

  1. Margent 提供コンテンツは、当方が著作権を保有するか、または適切な許諾を得て本アプリに同梱しています。
  2. ユーザーは Margent 提供コンテンツを、本アプリ上での個人的な視聴および付随する個人的な学習目的にのみ利用できます。
  3. 当方の事前同意なく、Margent 提供コンテンツを複製、転送、公衆送信、翻案、商用利用することは禁止します。

3.3 著作権者向け削除請求窓口 (DMCA)

配信者・権利者は、自らが権利を有するコンテンツが本アプリの処理対象となることを希望しない場合、お問い合わせ窓口までご連絡ください。確認のうえ原則 7 営業日以内に該当フィードを処理対象から除外します。

第 4 条 (禁止事項)

ユーザーは、本サービスの利用にあたり、以下の行為を行ってはなりません。

  1. 法令・本規約・公序良俗に違反する行為
  2. 他者の著作権・人格権・肖像権・商標権・その他の権利を侵害する行為
  3. 本アプリの生成する翻訳テキスト・合成音声を第三者へ再配布・公衆送信する行為
  4. 本アプリ・本サービスを商用利用・営利目的で利用する行為 (個人利用の学習目的を除く)
  5. 本アプリを逆コンパイル、リバースエンジニアリング、改変する行為 (適用法令により許容される範囲を除く)
  6. 本サービスのバックエンドに対する過度な負荷・スクレイピング・自動化された大量リクエスト
  7. 当方または第三者になりすます行為
  8. 児童の搾取・違法薬物・テロ等、各国法令で禁止されたコンテンツの処理を試みる行為
  9. 本アプリの正常な運用を妨げる行為

第 5 条 (利用料金)

  1. 本アプリの基本機能は 無料 で提供されます。
  2. 将来的に有料機能 (サブスクリプション等) を導入する場合、当方は本規約を改定し、購入時に明示します。

第 6 条 (免責事項)

AS IS 提供

本アプリは現状有姿 ("AS IS") で提供されます。 完全性、正確性、特定目的への適合性、安全性、継続的な提供のいずれについても、明示・黙示を問わず保証しません。

  1. AI 翻訳および音声合成は機械処理の性質上、誤訳・不適切な表現を含む可能性があります。重要な意思決定・業務利用にあたり翻訳結果をそのまま使用することはお控えください。
  2. ユーザー指定コンテンツの内容、品質、合法性、著作権処理状況について、当方は責任を負いません。
  3. 本アプリの利用に起因してユーザーに生じた損害について、当方は適用法令で許容される最大限の範囲で責任を負わないものとします。
  4. 当方の責任を完全には免責できない事由 (故意・重過失等) による場合、当方の責任は、当該損害発生時から過去 12 か月にユーザーが本サービスに対して支払った金額 (無料の場合は金 1,000 円) を上限とします。

第 7 条 (本サービスの変更・中止)

  1. 当方は、ユーザーへ事前通知することなく、本サービスの内容を変更・一時停止・終了することができます。
  2. 本サービスの変更・停止・終了によりユーザーに生じた損害について、当方は責任を負いません。

第 8 条 (個人情報の取扱い)

ユーザーの個人情報の取扱いについては、別途定める プライバシーポリシー に従います。

第 9 条 (App Store / Google Play 経由の利用)

  1. 本アプリを Apple App Store または Google Play から取得して利用する場合、各プラットフォームの利用規約 (Apple Media Services Terms / Google Play Terms of Service) も併せて適用されます。
  2. 本規約と各プラットフォームの規約が矛盾する場合、当該プラットフォーム経由での利用に関しては、各プラットフォームの規約が優先します。
  3. Apple App Store からダウンロードしたユーザーへの追加条項:
    • Apple Inc. は本規約の当事者ではなく、本アプリに関するいかなる責任も負いません
    • 本アプリのメンテナンス・サポート義務は Apple Inc. ではなく当方が負います
    • 本アプリが第三者の知的財産権を侵害するとの申立てがあった場合、その対応は Apple Inc. ではなく当方が行います
    • Apple Inc. および Apple の子会社は、本規約に基づく第三受益者として、本規約をユーザーに対して直接執行することができます

第 10 条 (規約の変更)

  1. 当方は、必要に応じて本規約を変更することができます。
  2. 重要な変更を行う場合、本アプリ内通知またはサポートページ (本サイト) において、変更内容と効力発生日を事前に告知します。
  3. 効力発生日以降、ユーザーが本アプリを継続して利用した場合、変更後の本規約に同意したものとみなします。

第 11 条 (準拠法・管轄)

  1. 本規約は日本国法に準拠して解釈されます。
  2. 本アプリまたは本規約に関連して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Introduction

These Terms of Service ("Terms") govern your use of the mobile application Margent ("the App") provided by Masashi Umetani ("we" / "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. The Service

  1. The App processes public podcast feeds you choose to subscribe to. It performs:
    • Audio file fetching and on-device storage
    • English transcription
    • AI translation to your target language
    • Text-to-speech synthesis of the translation
    • Comprehensible-Input alternating playback for language learning
  2. The Service is offered primarily as an accessibility/learning aid.
  3. No account registration is required.

2. Content and Copyright

2.1 User-selected content

  1. Access to third-party podcasts is initiated by your own search, selection, and subscription.
  2. You are responsible for ensuring your use of the feeds complies with applicable copyright law and the feeds' own terms.
  3. The App processes acquired content only for you, on your device and our servers. No redistribution to other users.
  4. Derived translations and synthesized audio may be used only for your personal study. Redistribution, public transmission, and commercial use are prohibited.

2.2 DMCA / Takedown

Rights holders who do not want their feeds processed by the App can contact us. After verification, we will remove the feed from processing within 7 business days.

3. Prohibited Conduct

  1. Violations of law, these Terms, or public order
  2. Infringement of third-party rights (copyright, personality rights, image rights, trademark, etc.)
  3. Redistribution or public transmission of translations / synthesized audio
  4. Commercial or for-profit use (personal study excluded)
  5. Decompilation, reverse-engineering, or modification (except as permitted by applicable law)
  6. Excessive load on the backend, scraping, or automated bulk requests
  7. Impersonation of us or any third party
  8. Processing content illegal under any applicable law (child exploitation, controlled substances, terrorism, etc.)
  9. Interfering with normal service operation

4. Pricing

  1. Core features are provided free of charge.
  2. If we introduce paid features (subscriptions, etc.), we will amend these Terms and clearly disclose at the time of purchase.

5. Disclaimer

AS IS

The App is provided "AS IS". We make no warranty (express or implied) as to completeness, accuracy, fitness for a particular purpose, safety, or continued availability.

  1. AI translation and speech synthesis may produce inaccurate or inappropriate output. Do not rely on the output for critical decisions or professional use.
  2. We are not responsible for the content, quality, legality, or copyright status of user-selected feeds.
  3. To the maximum extent permitted by law, we disclaim liability for damages arising from use of the App.
  4. Where liability cannot be excluded (e.g. intent or gross negligence), our total liability is capped at the greater of (a) amounts you paid for the Service in the 12 months prior, or (b) JPY 1,000 for free-tier use.

6. Changes and Termination

  1. We may modify, suspend, or discontinue the Service at any time without prior notice.
  2. We are not liable for damages resulting from such modification, suspension, or discontinuation.

7. Privacy

Personal data is handled under the separate Privacy Policy.

8. App Store / Google Play

  1. If you obtain the App via Apple App Store or Google Play, the respective platform's terms (Apple Media Services Terms / Google Play Terms of Service) also apply.
  2. If these Terms conflict with the platform's terms for that distribution channel, the platform's terms prevail for that channel.
  3. Additional clauses for Apple App Store users:
    • Apple Inc. is not a party to these Terms and has no responsibility for the App.
    • Maintenance and support is provided by us, not Apple.
    • We, not Apple, are responsible for addressing IP infringement claims.
    • Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may directly enforce them against you.

9. Amendments

  1. We may amend these Terms as needed.
  2. For material changes, we will give advance notice (in-app or via this support page) including the effective date.
  3. Continued use of the App after the effective date constitutes acceptance.

10. Governing Law and Jurisdiction

  1. These Terms are governed by the laws of Japan.
  2. The Tokyo District Court shall have exclusive jurisdiction over any dispute relating to the App or these Terms in the first instance.
